Terms of Service

PBM Puribeautymaker

 

  1. General

The terms and conditions apply to all services and products that are provided, delivered and sold by Puribeautymaker (hereinafter referred to as “supplier”) for the customer or buyer.

Deviating regulations only apply if they have been expressly agreed in writing between the provider and the customer. By completing and sending the order for the relevant products, the customer accepts these conditions.

Special or general contractual terms that contradict these GTC will not be accepted by the provider and will not apply to the relationship between the provider and the customer. Individual agreements take precedence over these GTC.

 

   2. Conclusion of contract

The contract between the customer and the provider comes about by sending the order, executing the desired service or booking a service as well as training. The content and scope of the service result from these General Terms and Conditions or from any individual agreements.

Unless limited, offers are always non-binding until the conclusion of the contract, in particular with regard to prices, delivery obligations, quantities and times.

 

   3. Prices

Prices are in Swiss Francs excl. VAT. The supplier's list prices valid on the day of the order are decisive.

 

   4. Services of the Provider

The provider provides services that are carried out carefully to the best of their ability.

The provider has the right at any time to change the type, scope, price, purchase conditions and purchase channels of the services provided by her and to completely refuse her services in the event of default in payment or other breaches of duty.

 

   5. Customer Obligations

The customer undertakes to pay the agreed fee.

The customer is obliged to take all precautions so that the provider can provide its services for the customer. Depending on the circumstances, this includes providing suitable information and documents and possibly a signature for the bidder.

 

   6. Withdrawal

In the case of training courses, the following costs are due if the customer withdraws:

Catching up on the training days outside of the agreed dates costs CHF 350 per day.

An additional CHF 150.00 with an existing class if possible or CHF 450.00 with an additional booked day.

In the case of partial or installment payments, the certificate will only be issued after receipt of payment.

The following costs will be charged for services in the event of non-appearance without timely cancellation (48 hours): Payable within 10 days

In the case of a justified exclusion from the training by the management due to intentional misconduct on the part of the participants, there will be neither a pro rata refund nor a waiver of the training fee.

 

It is your responsibility to ensure that participants have adequate insurance coverage. The provider rejects any liability.

 

   7. Return

The customer can return the goods purchased in the online shop (with the exception of training courses and vouchers) within a period of 7 days and withdraw from the contract. The costs for the return shipment are borne by the customer.

 

   8. Diploma

After successfully completing the training, the customer receives a diploma.

 

   9. Deliveries

The place of performance for the deliveries is the registered office of the provider. The transport risk passes to the buyer when the goods are handed over to the post office or parcel service, to the forwarding agent or freight carrier, but at the latest when they leave the company building. The packaging and postage costs will be charged to the buyer.

 

   10. Delivery Dates

Certain delivery dates are generally not agreed. Stated delivery times are for guidance only. The customer is obliged to accept the delivered goods.

If the provider is unable to fulfill its delivery obligations due to operational disruptions, labor shortages, strikes, failure to supply itself, fire damage, armed conflicts, official orders, significant changes in currency conditions or as a result of force majeure, it is released from its obligation to perform.

The buyer can only derive a claim for damages from late or delayed delivery if the seller can be accused of intent or gross negligence. If the provider should be obliged to pay damages, the amount of liability is limited to the net invoice value. Loss of profit, consequential damage and damage to third parties will not be compensated.

 

    11. Force Majeure

If the timely fulfillment by the provider, its suppliers or third parties involved is prevented as a result of force majeure such as natural disasters, earthquakes, volcanic eruptions, avalanches, storms, thunderstorms, storms, wars, unrest, civil wars, revolutions and uprisings, terrorism, sabotage, strikes and nuclear accidents or . reactor damage is impossible, the provider is released from the fulfillment of the affected obligations for the duration of the force majeure and a reasonable start-up period after its end. If the force majeure lasts longer than 30 days, the provider can withdraw from the contract. The provider must reimburse the customer in full for any payment already made.

Any further claims, in particular claims for damages as a result of vis major, are excluded.

 

    12. Force Majeure

The customer can pay the amount owed in cash or via TWINT. Unless otherwise agreed in writing, the invoice amounts are payable within 30 days of the invoice date, net cash, free of postage and expenses. The purchaser is not permitted to set off payments due to any counterclaims.

Payment in installments for services (PMU Permanent Makeup) is possible from a total amount of CHF 300 net, in a maximum of 2 installments. The first installment is due on the day the service is performed. The customer has 30 days to pay the second installment. An agreement must be signed on site, the customer will receive a copy.

For training, the customer must pay the amount in cash or via TWINT. In order to confirm and carry out the training, an advance payment of CHF 300 is required. Payment by invoice is only possible after an examination, whereby the invoice must be paid at least 7 days before the training date.

After the period of 30 days, the buyer is in default. Subject to the registration of further rights, the provider charges the buyer interest on arrears in the amount of 5% of the purchase price. The buyer's default occurs when the time limit has been exceeded without the need for a reminder.

 

   13. Warranty

Any warranty is completely excluded for the services.

The statutory warranty provisions apply to the performance of products. The provider guarantees that the product corresponds to the product specifications. The provider must be notified immediately of any defects. The provider is entitled to decide whether the defective product will be repaired or replaced. The customer is not entitled to a reduction or refund of the purchase price. The right to reimbursement of costs for third-party repairs is also excluded. During the repair period, the customer is not entitled to a replacement product. The warranty begins anew for the repaired item, while the original warranty period continues for the remaining items of the product.

For all Serge Louis Alvarez products, goods sold on order can only be returned unused and unopened, with all outstanding balances required for returns to be accepted. Complaints about services in the areas of PMU, microblading, henna brows, lash lifting and eyelash lengthening are only valid within 4 days and must be reported immediately. It is up to management to decide whether to make a correction, with the cost of materials to be paid by the customer. If the care instructions are not observed, no guarantee services will be accepted and the costs must be borne by the customer. In the case of external work, a new set is always made and invoiced. The final decision always lies with the management.

 

   14. Liability

Liability for any indirect damage and consequential damage is completely excluded.

Liability for direct damages is limited to the selling price of the affected product/service. This limitation of liability does not apply to direct damage caused by gross negligence or intent.

The customer is obliged to report any damage to the company immediately.

Any liability for auxiliary persons is limited to the same extent.

 

   15. Intellectual Property Rights

Any content of their services made available by the provider is protected by copyright. The use and payment of the services by the customer do not result in the transfer of intellectual property rights.

 

   16. Privacy

The provider takes all reasonable measures to protect the data stored with it. Access by third parties to the data stored by the provider or a contractual partner of the provider does not lead to the liability of the provider and its contractual partners.

The provider uses customer data to fulfill the services offered in accordance with the contract and the law, to maintain customer relationships and to submit offers.

The customer fully agrees to the storage and use of his data by the provider. The customer can prohibit the use and processing of his data for marketing purposes at any time.

 

   17. Severability Clause

Should any provision of these GTC be or become invalid, the remaining provisions shall remain unaffected. The invalid provision is deemed to be replaced by an effective provision that comes as close as possible to the intended economic purpose of the invalid provision. The same applies to any loopholes in the regulations.

 

   18. Governing Law, Jurisdiction

These GTC are subject to Swiss law. Insofar as there are no mandatory legal provisions, the court at the Provider's registered office is responsible. The United Nations Convention on Contracts for the International Sale of Products (SR 0.221.221.1) is explicitly excluded.
